Welcome to iStitcher. By downloading, accessing, or using the App, you agree to comply with these Terms of Use. Please read them carefully. If you do not agree to these Terms, you may not use the App.

1. Acknowledgment

This agreement is between you and the Developer (referred to as “we,” “us,” or “our”) and not with Apple Inc. (“Apple”).
You acknowledge that Apple is not responsible for the App, its content, or any issues arising from its use.

Apple has no obligation whatsoever to provide any maintenance, support, or other services related to the App.

You further acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce its terms against you as such third-party beneficiaries.

2. Use of the App

2.1. Personal, Non-Commercial Use

The App is licensed to you solely for personal, non-commercial use.
Any other use, including distribution, copying, modification, or resale, is strictly prohibited without prior written permission from the Developer.

2.2. Compliance with Laws

You agree to use the App only in accordance with all applicable local, national, and international laws and regulations, as well as these Terms of Use.

2.3. Prohibited Uses

You agree not to:
  • Reverse engineer or modify the App, or attempt to access its source code, algorithms, or internal functions.
  • Use the App for unlawful purposes, including activities that violate intellectual property rights or privacy laws.
  • Upload or distribute malicious software, viruses, or harmful scripts that could damage or disrupt the App.
  • Bypass or disable any security features or technical restrictions.
  • Exploit vulnerabilities or misuse the App in any unintended way.
  • Upload, share, or store inappropriate content, including material that is offensive, obscene, defamatory, discriminatory, or otherwise unlawful.

3. User-Generated Content

3.1. Responsibility for Content

You are solely responsible for any content you upload, post, or share within the App, including but not limited to images, text, patterns, and comments (“User Content”).
You represent and warrant that you own or have the necessary rights to share such content and that it does not violate any third-party rights, including copyrights or privacy rights.

3.2. Appropriate Content

The App is dedicated exclusively to knitting, crocheting, and related creative activities.
You agree not to upload, post, or share any content that:
  • Is unrelated to knitting, crocheting, or textile crafts.
  • Is offensive, obscene, defamatory, discriminatory, or otherwise unlawful.
  • Promotes violence, hate speech, harassment, or any other harmful behavior.
  • Contains advertisements, spam, or any form of solicitation.
We reserve the right to remove or restrict access to any content that violates these guidelines or that we deem inappropriate for the App’s community.

3.3. Public Visibility

Content stored in the public iCloud database may be visible to all users.
You are responsible for ensuring that anything you choose to share is suitable for public display.

3.4. Moderation and Reporting

  • While we reserve the right to review or remove content, we are not obligated to actively monitor all user activity or submissions.
Users are encouraged to report any inappropriate material.
  • The App may automatically hide or restrict access to content that receives multiple user reports, pending review by the Developer.

4. iCloud Storage

4.1. Automatic Storage

Certain features of the App may automatically store data — such as posts, images, or activity records — in your personal iCloud account.

4.2. Exclusive iCloud Storage

All such data is stored exclusively in your iCloud account and is governed by Apple’s iCloud Terms of Service and Privacy Policy.
The Developer does not have access to this data.

4.3. User Consent

By using the App, you consent to this automatic data storage in iCloud.
You are responsible for maintaining sufficient iCloud storage space and for securing your Apple ID credentials.

4.4. Limitations of Liability

The Developer is not liable for any data loss, unavailability, or issues resulting from:
  • Insufficient iCloud storage space,
  • Compromised Apple ID credentials, or
  • iCloud service interruptions or malfunctions.

4.5. Disabling iCloud

If you disable iCloud access for the App, certain features may become unavailable or function with limited capability.

5. Subscriptions

5.1. Subscription Plans

The App may offer subscription-based services with different plans that include varying features, durations, and prices.
Details of each plan, including current pricing, are available within the App or on its App Store page.

5.2. Payment and Billing

  • Subscriptions are billed through your Apple ID account. Payment will be charged upon confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Renewal charges will be applied to your Apple ID account within 24 hours before the current subscription period ends, at the same rate unless otherwise stated.

5.3. Free Trials

  • If a free trial is offered, it is available only to first-time subscribers and cannot be combined with other offers or promotions.
  • If you do not cancel before the trial period ends, your account will be automatically charged for the selected subscription plan.

5.4. Cancellation

  • You can manage or cancel your subscription at any time by accessing your App Store account settings.
  • Canceling a subscription prevents future charges but allows continued access to paid features until the end of the current billing period.

5.5. Refund Policy

  • All subscription payments are non-refundable, except where required by applicable laws or App Store policies.
  • Refund requests must be directed to Apple’s App Store support, as payments are handled solely through Apple.

5.6. Changes to Subscription Terms

We reserve the right to modify subscription terms, including pricing and available features, at any time.
Any changes will be communicated in advance where required. Continued use of the App after such updates constitutes your acceptance of the revised terms.

6. Warranty Disclaimer

6.1. No Warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Apple has no warranty obligation with respect to the App or its operation.

6.2. Developer’s Limitation of Responsibility

The Developer is not responsible for:
  • Errors, bugs, interruptions, or delays in the App’s functionality.
  • Loss of data, loss of user content, or any damages resulting from the use or inability to use the App.
  • Issues arising from iCloud synchronization, Apple ID credentials, or other third-party services.

6.3. Content Disclaimer

The App allows users to post and share content related to knitting and crocheting.
We do not guarantee the accuracy, safety, or reliability of any user-submitted content, including patterns, instructions, or comments.
Users should verify any shared information before relying on it.

6.4. No Guarantees

The Developer makes no guarantees regarding the availability, performance, or results of using the App.
All use is at your own risk, and you understand that shared content may contain inaccuracies or errors.

6.5. Limitation of Liability

To the fullest extent permitted by law, the Developer shall not be liable for:
  • Any loss or damage to user data or devices.
  • Any indirect, incidental, or consequential damages resulting from your use of the App.
  • Any claims arising from user-generated content, interactions, or third-party actions.

6.6. Acknowledgment of Liability Limitations

By using the App, you acknowledge and agree to these limitations of liability.
You understand that your use of the App constitutes acceptance of these terms.

7. Intellectual Property

All content, design elements, source code, trademarks, and other intellectual property rights in the App are owned and controlled by the Developer.
You may not copy, reproduce, distribute, modify, or create derivative works from any part of the App without the Developer’s prior written consent.

8. Product Claims

The Developer is responsible for addressing any claims made by you or any third party relating to the App, including but not limited to:
  • Product liability claims.
  • Claims that the App fails to conform to applicable legal or regulatory requirements.
  • Claims arising under consumer protection or similar laws.
Apple is not responsible for investigating, defending, settling, or discharging any such claims.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in California, United States.

10. Legal Compliance

You represent and warrant that:
  • You are not located in a country subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country.
  • You are not listed on any U.S. government list of prohibited or restricted parties.

11. Termination

We reserve the right to terminate or suspend your access to the App, at any time and without prior notice, for conduct that we believe violates these Terms or is harmful to other users or to the App’s operation.
Upon termination, your rights under these Terms will cease immediately.

12. Changes to the Terms

We reserve the right to update or modify these Terms of Use at any time.
Any changes will become effective upon posting the updated Terms within the App or on the official website.
Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
